Co-op hsg society delaying transfer of property

Dear Lawyer Friends,

My father bought plot and built a bunglow in 1978 in a Co-Op Hsg Society.

Lease Deed was made and registered in 2002.

My father passed away in 2008. .We notified the Chairman and Secretary with death certificate of father and requested to add my mother's name.  We kept following but never received any update from society.

My mother passed away in 2015. Now we notified the chairman and secretary with mother's death certificate and requested to add my and my brother's name.

We are not getting any confirmation or reply from chairman/secretary of co-op hsg society. We (brothers) are interested in selling this property and buying our own homes.

Can someone plz guide in this matter ?

Regards,

Ek Nagarik

Hello EK NAGRIK!

Let me know in which state you have ur property sitauted at?

It is advisable to approach the Hon'ble High Court and get the Letter of Administration of Estate Certificate issued in favour of one of the Legal Heir for the said property. Then you need to write the society for trnasfer of ownership based on that certificate.
