Compensation for livlihood to a distressed family.

Dear Sir,

On the night of 29th January 14, one of my relatives died in a road accident on way from Pune to Ahmedabad in a bus which collied with a stationary HPCL truck on the highway which was full of diesel.  Due to impact the bus hit the tanker from behind, the tanker burst in flames and so the bus.  In this accident, eight other persons died and charred beyond recognition. After matching DNA, hospital authorities handed over the body to the relatives. 

Now, the problem is that the victim was the only surviving earing members in the family. He left behind two children aged 14 years and 11 years besides wife.  They do not have any source now to earn their livlihood. The victim did not have a regular job and was earning due to his own efforts and labour in a private capacity. My querry is that whehter (1) the wife of the deceased can claim compensation by way of employment from HPCL or otherwise. (2) Can she get some relief from PM Relief Fund.  Or (3) how much amount of compensation she will receive fromt the Tribunal under the Mother Vehcile Act and in what period and (4) Whether the transport company will be liable to compensate the family. This has become a life or death for the family left behind due to this tragedy.  Please suggest and we solicit your valuable opinion in this serioud matter.

1. what was the age of the deceased 2. monthly income of the deceased 3. is the bus govt. or a private one 4. driver of the bus possess the driving licence or not 5. bus was insured or not 6. permit of the bus is valid or not 7. give the correct information to calculate the compensation of the deceased , 8. keep atleast name and address of two eye witnesses with you , most better if they were passenger of the same bus , name of driver and his complete address , bus number , insurance company by whom the bus is insured and the complete address of insurance company 9. if you will collect all these record / details then your claim will be settled down within 12-18 Months .
