Consumer Court for a flat presently On Rent

Dear Learned Members, l have files a consumer court case against a builder for delaying the posession and claimed rent for delayed period. Now I am transfered to other city and the said unit is on rent to a tenant. Builder says that being unit on rent , buyer can not claim delay penlty being not a actaul user. How far builder is correct.
