Consumer protection act

Dear Friends,

I saw in so many cases, The Company is availing the services i.e courier, logistic, storage etc in the course of its business, in case of deficiency of services, the Company approch to the consumer forum and get the compensatin there.

But as per the basic of consumer law, service availed for earning the livelihood and consumption not for commercial purpose shold be covered by speedy and less expensive way of justice of consumer forum and the transaction of commercial nature should not be entertained by the consumer forum.

How the  company justify the transaction are not nature of commercial.

Please enlighten on the above issue.

Best Regards

Sunil

if the company purchases goods / hires services for its own usage but not for the purposes of reselling or rehiring the same, then the company becomes a " consumer" within the meaning of the Act since there is no commercial element in the said transaction.
