Whether legal heir can forego their benefits ??

The Management decided to pay a compensation to the legal heirs of a deceased employee. Now the father and mother giving undertaking that they have no objection and they forego their rights to claim the compensation and the compensation may be given to the wife of the deceased. Whether it is legally permitted by heir of a deceased in payment of compensation ?

Yes the interest can be relinquished in favour of other legal heirs.  It is perfectly OK.  A very fine and responsible gesture by the father, mother duo.

The rights of legal heirs can be renounced in favour of the other legal heir or legal heirs. It is desirable to take an affidavit executed by the legal heirs renouncing their rights, which can be executed before a Notary Public.

As Mr.Vasudevan suggested, a legal heir can very well relinquish their right in movable property in favour of another by executing a simple affidavit in this regard executed before and attested by a notary public.
