A private criminal complaint is filed u/s 200 Cr.P.C. Magistrate examined the Complainant on oath.

Whether the said private complaint can be read in evidence?

No. you will have to lead your evidence.

Accused wants to use the averments in the complaint in his favor. In the complaint the Complainant had leveled inconsistent allegations, whereas in the evidence Complainant had limited to one allegation.  Unfortunately the defense failed to bring on record the inconsistency in the complaint at the trial. Does the accused has any remedy now. Matter is now at the stage of argument.
