legal notice under sec 138 n.i act

sir I sent a legal notice under sec 138 n.i act. The prop. of the firm had been wrongly named on some other name instead of original proprietor, rest of the contents of the legal notice are correct. notice was duly delivered on accused. yet I have to file the complaint. please tell me how i correct my legal notice.

Just send another legal notice containing in its provisions as being a corrected version of the last one and you can mention that since the error was not so grave, the date of the notice stands retrospectively applicable. (Or if you think that the receiver can make this a ground to prolong the issue, just follow the date on this notice as effective and carry on.

Subject to limitation, You may either sent a fresh notice by correcting the errors and mistakes or you may again present the cheque and issue fresh notice to correct person (this is best mode).
