car parking

we live on the 2nd floor and are owner in possession. the person living on 1st floor is also owner in possession and claims his parking right just below our building.

the space is for two cars but he uses that space for his car and two wheelers, however it's an open area adjacent to road.

The presumption is that it is a public place and both of you are not having any exclusive ownership rights over the property.

There are specific car parking rules for CHS as also Court decisions. Consult the managing committee of your society and/or a practicing advocate.

If you have purchased the property with a earmarked car park in your Sale Deed, you can prevent the other from parking in your car park area. If he is not accepting you have to file only a Civil Suit preventing him from using the same. If there's no earmarked car park even then you have to file a Civil Suit.
