There is no such thing illegal now, if both parties engage in a play with consensus. The other spouse at the maximum, can expose them only to obtain a divorce and this is the maximum thing. As establishment of action requires evidence, that evidence acceptable to court may be secured to establish adultery. which is not a crime now.
