All are equal before law.

Section 45 provides for protection to members of the Armed Forces from arrest  for any act done or purported to be done by him in discharge of his official duties except after obtaining the consent of the Central Government. 

Else, for offences committed in personal capacity, he is liable like any other person.

The querist has nowhere stated that he was drunk as a part of duty.  He has simply set a question paper leaving facts to the imagination of experts.

Hard fact is that Armed Forces person is more vulnerable if caught by the police as compared with other govt employees. Once involved in criminal case he loses chance of promotion and their continuation in service depends upon the promotion earned. Further discharge during case invites consequences of deprivation of terminal dues to be released only if acquitted on merit (not on technical grounds)..

But in some cases unaware of of the AF persons when questioned by police then instead of being polite try to show colour of uniform and get harsher treatment.

Mr. Om Prakash, let strive to share knowledge but kindly do not impose frustrations, that too, through abusive expressions!
