Transfer of title of land to the plot-holder

Sir,

We members of RWA purchased plots in private colony approved by Town and Country Planning Haryana. Entire land over which  colony came up still remains on the name of company .Even Girdawari is in the name of company. Kashtkar (cultivator) is company. There is no land for doing Kasht(cultivation).

1. This girdawari should have been shown in the name of plot holder who are in possession of the land now. Does this Girdawari by revenue authorities need correction,if so ,what is the procedure.

2. Conveyance Deed (CD )was done for the plots around 2004-5 without giving Khasra Number in the deed,hence the land sold by coloniser is not in  our name. Plot holders will only get Title to the land when it is transferred in  revenue records lying with Patwari. We need to get the RECTIFICATION of CD done.

3. Kindly assist by guiding plot holders as to how to proceed for :-

a.  Girdawri Correction.

b. RECTIFICATION of CD  for plots.

Hello,

You have to register rectification deed with sub registrar and rectify the mistake in conveyance deed. After registration of rectification deed you can make entries in revenue records.

The legal basis of the state of affairs in most of the privately developed housing colonies are quite complex. In facts, these entities are beyond the reach of Rule of Law of our country.

However, title of the holder of the property is not dependent upon the entries in the revenue records.

As you are many, first form as a group, pool up some money, entrust this to local advocate for needed remedy.

If the land is approved by DTCP for residential / commercial purpose, land use stands converted from agriculture to residential, check the records.

How could girdawari of residential land can be in the name of vendor (seller), get the revenue (patwari) records endorsed accordingly, if not done.

It would be better to consult and engage a local prudent lawyer for appreciation of facts/ documents, professional advise and necessary proceeding.
