In the Case of Laxmi Raj Shetty vs.State of Tamil nadu(1988) the supreme Court held that :

1. The presumption of genuineness attached under S.81of the Indian Evidence Act to a NEWSPAPER report cannot be treated as to prove of the fact.
2. A newspaper is not of the document referred to in S.78bof the Evidence Act by which an allegation of fact can be proved.

It is a settled principle of law that news items published and statements of fact contained in a newspaper is merely hearsay evidence and
no judicial notice can be taken off the news item which is in the nature of hear-say evidence.
