Discrepancy in recuitment

Sir, I applied for a post through direct recruitment in the central university of Andhra Pradesh. I appeared in written test and skill test and I stood at 1st place in the merit list. But the university filled the post on deputation without considering the merit, which is against to the method of selection of that post as per recruitment rules of the university. Kindly guide whether this can be challenged in the court of law? Any Andhra Pradesh High court advocates?

You can ask the university authorities why they conducted tests without appointment and why deputation was taken using RTI. After receiving a reply, you can decide whether to approach the high court.

Sir, already obtained the information through RTI. They are saying university is empowered to fill up any post on deputation as per some clause. But here they clearly violated the method of recruitment of the post as per cadre recruitment rules. Can I approach the court of law?

If you are aggrieved by this discriminatory act of the university, you may file a petition for writ of certiorari mandamus before high court and seek remedy.

Whether the recruitment advertisement was for direct or depution has to be found out before taking further action.

However, you must move to high court / jurisdictional Tribunal or Court against such action of the University, which is illegal and invalid.

Seek professional services of a local prudent lawyer for proper analyses of facts, advise and necessary proceeding.

Before moving to high Court you should be sure about the provisions of recruitment rules for the post.

In RTI you cannot ask whysuch decisipnis taken.

 

But you can take all the papers lading to this selectipincluding noting on file.

 

You can have copy of he sameunder RTI Act.
