Society was formed against the will of the builder before about 16 years
in society only 7 floors / 7 family and ground floors shops / office
builder has not handed over Occupation certificate as of today as he has added 5 more floors
to the existing 7 story building though society has given permission to build 3 more floors only
against payment of Handsome amount + car stack parking + etc which he has not done as of now
and not even paying property taxes / bills of elevator company / etc, society has filed law suit in National Forum also
meanwhile society was billing / collecting funds to maintain the society / payment prop taxes / etc, i have been gifted the flat from my brother and society has carried out endorsement in 2015, at that time all the dues were current, now society has come us with statement for taxes from day 1 ( which is even before the society was in existence ) and asking me to pay the short payment from day 1 even i was not the owner, what are my rights ? am i responsible for society errors ??
since i had become member, i have been requesting allocation of parking ( 7 spots and 7 floors ) but secretary is parking two cars and depriving me off the parking, no members has paid parking charges as of now ( for over 17 years ) as 5 out of 7 cars are owned by managing comm members, neither they are eager to bring parking policy in place as they are enjoying for free, also i had asked excess to books / minutes / etc but no reply to my several request, recently even soc chair has erected new shed for parking his car + scotter, etc number of misuse of power
few months back they have served me legal notice demanding payment ( from day 1 ) and i have paid in part of it asking them reply my concerns / allocate the parking / etc, i have also informed dy registrar about the no reply for several request who in turn served notice to society to reply but they have remained silent, in turn they have filed law suit in COOP court mumbai for balance payment
what is my recourse here ?
can i defend myself or need to have a lawyer ??
how long it takes to resolve such matter ??
