A family court, on Monday, granted divorce to a railway employee from his doctor wife on grounds of ‘cruelty’ after the husband told the court that his wife would abuse him in writing and had called him ‘the ugliest creation of God’.
The court accepted the husband’s contention and passed the order dissolving the couple’s 14 year old marriage.
The husband in his petition in October, 2010 had stated that in 2001, three years after they got married, he was subjected to cruelty as there had been no physical relationship between the couple. He also said that they quarrelled frequently because of differences.
The court observed that in February 2009, following the passing of their pet dog, the situation soured further. The former wife moved out of the husband’s house despite his attempts to reconcile.
“After going through the pleadings, evidence and documents, it appears that the respondent (wife) used to abuse the petitioner in writing….and called the petitioner (husband) the ugliest creature of God and [a] sadist,” the court further observed.
When the husband sent a legal notice to his former wife in July 2009, the respondent allegedly replied in November 2012, asking him ‘to not threaten her any more’.
The husband in his application also contended that he had sent his former wife abroad to complete her further studies and that he had always tried to save the marriage.
In light of these contentions, the court observed that “the cruelty and desertion allegations made by the petitioner do stand unchallenged and I am of the view that the marriage has become a deadlock as it is not possible for the petitioner- husband to reside comfortably.”
