court summon 138 act

No act case court summon to residence address served by court police along with complaints party. But respondent out of station. Relative received xerox copy signed in orginal. Respondent not signed. My query respondent not recvd summon.. 2) before putting the argument summon not recvd appeared regularly in old court at karnataka , the same case transfered in tamil nadu can put the same argument in new court at tamil nadu( because root of case grom old court). Please suggest
