The Indian man can seek divorce on the ground of cruelty committed by the wife under section 27(1)(d) of the Special Marriage Act,1954. The court will send the summon to the wife in her country throufg Ministery of Law & Ministery of External Affairs and if she refuse or ignore to defend the divorce proceedings in Indian Family court, the ex-parte proccedings against her followed by the dissolution of marriage by decree of divorce will result.

In case wife comes to India for defending the divorce proceedings, the settlement for divorce by mutual consent can always be worked out between parties and amicably the issue will be resolved.
