I am only child( daughter) to my parents.my parents r separated but not legally since 15 yrs.we don't know my dad's wereabouts. I have been taking care of her since these many yrs.she s 74. Am 33yr old married .Hindu family.now my mother s final rights n cremation work can it be done by me ?? Legally what is the rule?? Since my dad too is a lawyer I don't want to create prob later so if I am gng to do this I need legal advice.I live in Mangalore Karnataka.
From what you write I presume that your mother is still alive and you are asking this query only for the future. There is no law enacted by parliament or state legislatures as to who can cremate. There are only Sastras and customs. According to Hindu Saatras only a son can perform the last rites. That is why people yearn for sons and resort to female foeticide etc. But things have to change. A daughter is as much a child of the parents as a son. You can go ahead and perform the last rites of your mother or even father. Your husband can also perform. Nowadays with couples conscious of family planning there are many daughter/daughters only families. There will be no sons. So you can very well perform the rites. You can call priests to assist you. If no priest comes do things yourself in the presence of well wishes. Also I say if the event happens during your monthly period, then also you can do it. It is your right. There will be no legal issues.
