Sirs,
I am married to my wife on 04-05-2003 and were living happily till May-13, during the past four years she had illegal relation with the house owner which was not known to me, as I am touring heavily. I have daughter of age 9 and son of age 7. When I came to know the illegal contacts I took them to their parents and shockingly came to know later that the were knowing this since Dec-2011.
Now I have the evidences for this adultery as the video recording confessed by father-in-law taken on mobile stating the full truth, and a mobile phone taken in to my custody which was provided by the house owner to her. That mobile is having some messages of threatening.
Since the complete truth was known to me, my wife immediately went to police station and given a hand written compliant stating that I asked to have relationship with her and now I am torturing her about how you had s*xual relation with him and also in the same compliant she had mentioned that her dowry needs to be returned back, also I am threating their parents for property transfer of their living house (all were false). This compliant was given when I was out of town.
I had given an complaint to Supt of Police, stating all the truth and a enquiry was conducted, as they were giving false information, I given in writing that I will take legal proceedings. But before that they had filed a maintenance case under CrPC 125 followed by Domestic violence prevention act 2005 Sec-12.
I lived a faithful life with her during the tenure of stay, I have photographs of taking her during the annual vacation to various places in the country. She had taken the stance of cruelty as the ground for separation and asking for maintenance under CrPC 125. Additional compensation of INR 15 Lakhs under the second case.
Following are the evidences with me,
1) Initial police compliant raise by my wife confessing that she had relation with house owner.
2) Her father confessing a giving a audio statement.
3) The mobile phone which was used by her (given by house owner) having sms threatening her. (presently checked the custodian of the phone which was used by her and in the number she received sms, unfortunately the custodian has been changed. also tried to get the name transfer details through RTI, which was not provided)
4) Photographs of last 6 years displaying good moments lived with her and my kids. (taken in various tourist places)
Based on the above evidences, how is my case, can I fought for justice?, I am want my kids to me.
For no mistake, mow I & my kids were paying the price of separation, and I am sure my in laws can't grow them properly, my kids are in wrong hands.
Pl guide me to fight for Man's justice.
