Decree and ownership

An urban property in HUDA records stands in the name of Ravi Parkash for the last 50 years. With the mutual understanding of Ravi parkash and his younger brother sant parkash, the same property is in the possession of younger brother sant parkash.

Both of the brothers had passed away about 20 years back, right from 50 years no one has claimed for the property from the HEIRS of Sant Parkash and right from the very beginning the same also stands in the municipal records and in all govt records such as, public health, electricity dept, telecom dept.,  in the name of younger brother sant parkash.

Now the question is : -

Can legal heirs of sant parkash claim ownership on behalf of more than 50 years possession .

Or a suit can be tried for decree in favour of the legal heirs of sant parkash.

You have to file "declaration suit" making legal heirs of Ravi Praksh also.
