Decree of divorce

Dear Expert,

Our marriage has been dissolved by a decree of divorce from family court on 05/11/2014.

If operation of this decree may be stayed by higher court?

on what ground?

whenever there was nothing in the trial that they want to live together.

Dear, Unless any party between you and your wife files an appeal, HC will not do anything on its own.

Once decree awarded by court both the parties are free to remarry. 30 days appeal period is binding to both the parties or not?

Appeal period is 90 days, not 30.

After the expiry of appeal period if no appeal is filed then both the parties are free to marry.

In case of decision of family court the appeal period is 30 days.

section 19 of family court act 1984 provide it

My problem is this whenever court awarded decree on consideration of facts of case. How higher court may stay the orders/decree?

When wife files case against husband for asking divorce on cruelity and maintainance too.. And the husband did not attend the trail completely..and the case stands exparty and judgment reserved state... in this case normally how many days will it take to get the divorce for a normal district Court in india?
