Managing committee of a Co-op. hsg. society is framed before registrar, municipality by a member for illegalities. Chairman make a complain to the employer of the member,makaing defamatory allegations against the member, asking suspension of the employee.Employer ( Central govt. ) investigate the complaint but nothing is found truth. Still employer issues a memorandum to the employee that, " Your such act bring disreputation to the organisation" without giving the proof of disreputation.
Employee already started civil and criminal suit against the chairman of the society for defamation.Whether action can be initiated against the employer for makaing the allegation of disreputation . Pl. provide the details of procedure or any case history.
