I have been scammed , can i get justice

I am studying in an online coaching and they took ₹59,590 ( simply ₹60,000) including GST for 11th+12th class online IIT JEE course . I joined it on 21 April 2024  and coure is valid till 31 May 2026 but I joined the coaching when course had already started 1 month ago that is in March 2024 so I didn't took live classes but only the recorded classes in their app for covering the 1 month lectures  . When I joined live classes after  month I saw that the teachers I was promised before buying course in the youtube video was not teaching us except one teacher of physics ,but soon after some months ,that teacher also left leaving some other unknown teachers for me to teach . Also they claimed in the video that we only have upto 200 students in a live classes for better understanding. But after joining the classs, I saw more than 200 in the online classs. But I endured it for a year as of December because I was in midway of my year ,so I thought complaining then would effect my study . Now please tell me what to do in December, they don't have a refund policy but they scammed me through false claims .

They also emotionally controlled me like they told me that your seat has been reserved for 2 days and if you didn't buy course ,you will not be able to join later but after purchasing I saw there are more than 200 students .

I'm really sorry to hear about your experience with the coaching center. It sounds like they made several false claims and didn't deliver on their promises. Here are some steps you can take to address this situation:

1. **Document Everything**: Keep a detailed record of all communications, advertisements, and promises made by the coaching center. This includes screenshots, emails, and any other relevant information.

2. **Review the Terms and Conditions**: Check the terms and conditions of the coaching center to see if there are any clauses related to refunds or false advertising. as if they dont have one, then they are likley are eligible to be sued for this .

3. **Contact the Coaching Center**: Reach out to the coaching center and express your concerns. Request a refund or some form of compensation for the false claims and lack of promised services.

4. **File a Complaint**: If the coaching center does not respond or refuses to address your concerns, you can file a complaint with the appropriate consumer protection authorities in your state . You can contact the **Department of Consumer Affairs** or use online platforms like **Consumer Online Dispute Resolution (ODR)**.

5. **Seek Legal Advice**: Consult with a local lawyer who specializes in consumer rights to understand your legal options and the best course of action.

6. **Share Your Experience**: Consider sharing your experience on social media or review platforms to warn other potential students about the coaching center's practices.

Remember, you have rights as a consumer, and it's important to stand up for yourself. If you need more detailed guidance, you can refer to resources like the **Consumer Protection Act, 2019** and the **Department of Consumer Affairs** website.

Would you like more information on any of these steps? just tell me ..

No doubt such online scams are very popular especially by not imparting education to the required standard and when you make a complaint they will give a lethargic and lukewarm response.

If you feel that their services are deficient to that of what was ppromised to you, you may communicate to them by a notice stating that you are unsatisfied about the services hence you would discontinue, and ask them to refund the amount collected proportionately .

Failing to respond or not complying with the demands made, you may approach consumer forum with a complaint for the acts of deficiency in service and for unfair trade practice.

The action of coaching centre is illegal which require to be assailed.

You should seek professional services of a local prudent lawyer for proper analyses of facts, professional advise and necessary proceeding.

You can very well proceed to file your case as party in person if you are well aware of the legal procedures to be followed/complied with in this regard.

I filed complaint in National consumer helpline is it enough

That is not sufficient, you have to follow it up to get it converted into regular case before the consumer distress redressal commission if you are really serious to get relief and remedy to your problems.

Please note that that the National Consumer Helpline (NCH) is not a consumer court, but it is a grievance redressal mechanism that can help consumers before they go to court.

The NCH is a service of the Department of Consumer Affairs, Government of India, that helps consumers with grievances. It's a central registry for consumer grievances that allows consumers to register their grievances online, by phone, or through other channels.

If a consumer is not satisfied with the NCH's resolution, they can approach the appropriate Consumer Commission..
