Shop evacuation

Sita , aged , 85 years who is survived with her 2 daughter ( husband and sons died) has given one shop on renatl basis the agreement of which is expired on 13-Jan-2025.

Sita gave verbal notice 3 months before to tenant to which he agreed upon that he would vacate .

Now tenant is saying that he will not vacate the shop and trying to file a false case against Sita so that by the time judgement would come SIta might be dead and he will enjoy the occupany of property safely.

 

What Sita should do ? Does forceful evacuation by help of Police station helps here ?

The successor of deceased landlady-cum-owner has every right to get the shop vacated and tenant has to handover vacant possession and/or face eviction through jurisdictional Court of Rent Controller.

What is your personal problem / dispute or locus standi qua the post?

Law is not like what you interpret, even if the owner of the premises passes away the case will continue through the legal representatives.

Police will not interfere in the civil matter to evict the tenant, the owner has to look for remedy through court alone
