For your 1: Relief under S. 12,18,19,20,21 DV Act are under discretionary powers of a JFMC
For your 2: S. 473 CrPC a Magistrate delay in taking cognizance - Condonation - Power of Court is discretionary in reference to context of S. 498a IPC.
