Divorce

Can false compl�int given by wife at women's help cell be used as ground for cruelty while fighting for divorce. Compl�int consists of dowry demands and violence by family members of husband.all of them are false accusations. Women's help cell have closed the complaint after couple of rounds of counseling. They have not forwarded the complaint to police station. Husband has collected the copy of complaint by RTI.

POLICE STATION/ CWC

- Facilitating emergency services like medical help and temporary shelter to women in distress

- Filing the FIR in cases of matrimonial disputes, violence for dowry demands and the cases of domestic violence after the proceedings of counseling unit and mediation cell.

- Investigation after registration of case and recovery of Istridhan and dowry articles.

- In case of any complaint, concerned ACP and Vigilance unit of cell are also informed to provide the client with necessary help/support and provide relief to the victim.

You have to poove that those complaints were false because she will definately file those complaint copies in her defense saying  that you was curel towards her.

In case of complaint:  It is better if inquiry/investigation has proved that there is NO substance in complaint and allegations leveled were false.

And the person has substantial and irrefutable evidence to establish that  complaint/allegation is false.

Husband has filed for divorce now . My query now is that whether he can use that complaint as cruelty when arguing for divorce. Since the allegations were false husband offered them to file complaint if they wish to do so.after that wife has given in writing not to close the complaint in women's help cell and she has not attended the further counseling. So far she has not filed complaint with the police. Meanwhile husband has filed for divorce. Whether he can use that complaint also as a part of cruelty?
