Hello,

You have to approach court for divorce and file petition for divorce. Divorce application is based on facts of the case. Please state the facts so that experts can advice you.

please describe about 01 year separation period which is mentioned in procedure...

The essential conditions under Section 13B of the Hindu Marriage Act are as follows:

(i) Husband and wife are living separately for a period of one year or more.

(ii) that they are unable to live together.

(iii) And both husband and wife mutually agreed that the marriage had ended completely. Hence marriage should be dissolved. In these circumstances, divorce can be filed by mutual consent.

any provision when husband and wife living separately over the 7 years for from the side of husband where there multiple cases like FIR u/s 498, cases registered under DV act, charging maintenance u/s 125 under crpc
