divorce

maine aur mere husband ne 29 january 2021 ko mutual consent se divorce case file kiya tha hamari shadi nov 2019 ko hui thi aur shadi ke 15 din bad se hi hum log alag rah rhe h 4 march ko meri first mediation date h jisme mere pati nhi aana chahte h kyunki unke pas in sabke liye time nhi h as he says he is busy ese me mai kya kru kya mere akele date pr jane se koi benefit h mai jald se jaldi divorce chahti hu uske liye mujhe kya karna chahiye plz mujhe
bataye ki mai jaldi divorce kese lu aur apne pati ko court ki tareekh pr kese bulaun plz help me

Mediation process requires both the parties in order to resolve the matter successfully such that divorce can be prevented.

In case your husband doesn't shows up in the mediation on the first date it won't lead to result of the mediation, but a prior reminder would be given to him.

However, if he states or refuses to attend any of the mediation dates then the mediator would inform the court about the matter stating that the party isn't interested in resolving the matter.

A court can give two response upon the said matter that is either the court will ask him to attend the mediation or else the court will simply lead to the divorce Judgment.
It all depends upon the discretion of the court.

It is mutual divorce, ye to mutual divorce hain aap ko mediation kyoun chayie, inform court that both of you want divorce no mediation requiered. Instaed made a divorce deed and file in court get decree.

you can appeal in court for dismissal of mediation and other party should not have any objection in that , if they have objection , it means other party want to linger on.

we both filed a divorce case infront of megistrate by mutual concent i dont know why this mediation is necessary i think its a procedure and everybody have to go through it

Don't worry if your husband don appear even in divorce case you will get an exparte divorce. IT will be better if you can make a divorce deed upon mutual agreed terms and conditions, upon filing that in court you can get a decree that is too easiest and most expeditious way.

Dear Querist, you must go and attend the mediation and told the counselor/mediator to sent back the case to Concern Court so that court can get back the file else the Court will not able to pass appropriate order in the absence of report of the Mediator.

YOU CAN RECORDING THE MOBILE  WHEN HE DENIED OR WATS APP MESSAGE TO THEN COURT WILL THINK IN YOUR FAVOURE AND YOU WILL GET DECISION IN YOUR FAVOUR.....PLEASE UPDATE TO THE COURT
