Hello,
I have filed Divorce case in Family court on 23-March-2011, Now 3 Months and 3 Date are passed, but my wife was not present for a single date, also we didnt got any recieved receipt of Court Notice to her.
I am staying in Pune and she is staying in Hyderabad
What i have to do if see remain absents.
Please Help

Assuming that the case is filed before Pune FC.
1. Do a file inspection first by way of allowing such application to find if the Service was effected upon her.
2. If Service not effected then on next date press for supplimenatry service such as 'Pasting'.
3. If on next date after 'pasting" also she does nto appear then pray for Newspaper Publication.
4. On next date post paper publications place evidences followed by arguments and press for ex Party Decree in Divorce proceedings.
5. If the brief's stated Service was effected earlier and she didnot appear on three dates as per your brief's then place evidences followed by arguments and press for ex Party Decree in Divorce proceedings.
6. Execute the Decree in 30 days via Execution Court before re-marriage and after 90 days you are a free person to re-marry.
