After issuing a Lawyer's notice for my wife to return from her parent's house as she left thr an year ago for child. As the notice remains unanswered and she does nt return because she lost interest in me. Can I apply for divorce?

1. For using 'desertion" as ground for divorce one has to wait minimum 2 years assuming parties are Hindus.
2. Private Notice in reference to context has secondary evidence in Law if not followed by S. 9 RCR HMA motion in Court assuming parties are Hindus.
