I was married in 2008. From 2012 I and my wife are living separately. I filed for divorce on the grounds of mental harrassment and dessertion in 2013. In 2018, the case got dismissed saying that In the cross-examination, I agreed to take back my wife if she dont file any false complaints against me and my wife said she is ready to come to family. in 2017 dec, she filed for MC. Appear against this was made in high court but the lawyer didnt attended property after 2 years he said its of no use as you both agreed to back to family. Now its already 2021 still my wife never back and MC is in still in-progress. Its been 10 long years we are separated. we have 2kids as well 2nd kid she was carrying when the time she left.
Please advise me the next step. I need divorce ONLY. Please suggest what to do? some told seperation more than 5 years leads to divorce. Is it true. My wife is not agreeing for divorce as she saying after your death i will get your property.
