Adv. Chandrasekhar (Advocate)     06 October 2011

Mr. Vikas Mahajan,

I have not given any reply to your question pertaining to deportation of your brother-in-law.  I cent percent agree to the response of Mr. Victim about deportation.  Deportation is not going to happen at any cost.  The matrimonial crimes are not heinous crimes.  Even in heinous crimes havinng political ramifications, indian government is failing to get deportations.  For example Quatrochhi's case and recent Kim Davy's case (purulia arms droop case).  But attaching the property of husband is not difficult once you succeed to serve summons on his address.  After successful serving of summons, the procedure laid down in Section 82 declaring him proclaimed offender and attaching the property will be done in natural course.
