Dear Experts,
Is it right move to file the divorce petition by husband who has two kids of 6 and 5 years of age each, because wife is not showing any interst to come and join.she already filed the 498A and DV which are yet to start the trail.
will there be any chance for husband to get the divorce baased on 498A cruelty.
pls advise if huband can file the divorce petion now ro wait until the 498A and DV closed.

The choice is your's to file for Divorce .As for the two kids you can apply for custody .As for the 498 A or the DV to conclude it takes 5-7 years :-).

It is you who has to decide, why and on what grounds you want divorce.
However, the consideration of the welfare of the child should weigh in your mind as well, while deciding whether to go for divorce or reconciliation.
