Mohit Bhatnagar (Asst. Manager)     30 June 2012

Divorce is right decision for me

Hello

My Name is Mohit Bhatnagar. I am a resident of Delhi. I have been married in January 2008 with Bharti (my wife) in Bulandshahr (Up). We have a 3 years old daughter. It was some between rakhi occasion where she wants to go her parents home and i want she just stay back at home on this occasion as i want to celebrate this occasion with my daughter and with my parents. But her parents and my MIL has taken her and my daughter forcefully from my home and her uncle has theaterened me and my family that he will see us in the court. after 15 days i made my wife understand and take her back at my home. but after her return i came to know that she has taken an admission in a teaching institute without my concern and fees has been paid my fater in law. she wanted to stay at her parents home to complete the course whose duration was for 2 years. i refused her and told her i will get her admission for B.ed in Delhi if she wants to become teacher. But only with in 15 days she left my home with my daughter and filed a complaint againse me in my local police station that i was beating her and went to her parent's home. i have been arrested by police staff and granted me go after taking some money from my family. One night again police men came to my house and ask me and my parents to get ready to go to Bulandshahr as my wife filed a FIR under section 498 case. police men taken me and my father to the jail and after so many discussion with both of our family members an agreement has been done. but she did not come. after so many request and so many phone calls she atlast ready to came again in my house, but after one month she again has been taken back by her brother and their uncle. she challenged that fir compromise in the local court and also filed a case against CRPC 125. in the meantime they never allowed me to meet with my daughter. i have also filed a case against her under section 9. after two months i have been requested them for compromise and me and my family visited at their place. they said my wife wants divorce and as a compromise part we need to ay 12 lac as marriage expenses and 2 lac for my daughter's expense and also they will not allow me to meet my daughter lifetime. i have taken time from her family and came back. i am only earning 34k per month and i am not able to pay this much of amount where i am not able see my daughter lifetime. i love my daughter so much and i always tried that my wife come back at my house but they never want. should i kae back my application under section 9 and file a divorce case against her. what should be positive and negative sides of this action and what should i need to pay? what action should i take against her 498 case which she has challenged in the court by saying that me and police has made compromise by our own where she has also signed on that agreement and there are two witnesses from both sides and it was also signed by police captain of Bulandshshar.

Kindly suggest what can i do now?
