Divorce petition.

Dear Sir,

            Please fill me up on my 2 queries.

1)Can a husband file for divorce from the town he resides if the wife has left taking his children and gone to her parents place?And in the divorce mention that he wants the custody of the children back to his home town where he resides?

If you and she were residing there before desertion then surely you can apply in your town. You should file seprate suit for the custody of child.

Both of us were residing in my town before desertion.But i have been told that custody of the child has to be filed where the child resides and not where the father resides.Please advise.
