me and my family are falsely accused in 498a,DV case by my brother's wife before 5 years, girls side want to go for settlement and we agreed the same, so our lawyer has prepared the memorandum and asked the girl to sign it stating that she will withdraw all the cases by going for a settlement and further she will not put any case. our lawyer told that we will submit the signed memorandum in a divorce court and give the girl 50% of the settlement amount.
question
1. once the memorandum is filed in the court. can the girl family go against it?
2. which is the best way to pay the settlement amount (DD or cheque?)
3. If the girl family go against the memorandum , can we file a cheating case against him or what are actions can be taken?
4. will the memorandum file in the divorce is applicable in the criminal cases ?
