Domestic Violence

Hi, My wife has been living at her matrimonial home since last 2 yrs. She has filed all the fake charges and cases against me and my family in these 2yrs. Recently about a week ago she has filed Domestic Violence against me and my family. How come she could file a domestic violence after living separate for almost 2yrs? Moreover me and my wife has not lived with my parents after my marriage still she has filed all the cases against my parents. Also this b*tch has now started affair with her own lawyer who is also happened to be her Jijaji. I have got few evidence and also my wife's call details to prove their relationship, as they talk to each other in late night. Please help me to find how to defeat this kind of b*tch as she has made my life like hell. Due to all these mental harassment and police cases, I have lost my job. I had also taken a bank loan and started a beauty salon for my wife, but she left me about 2yrs ago and I had to close down that beauty salon, but I am still paying for Bank instalments. This is really a situation where I thinking of committing suicide because my parents are bearing because of no fault of their own. My dear friend don't worry.she can't trouble you for long because court wont definitely believe her cookedup stories and the truth would come out soon.there are judgements which say that dv can't be filed when separation is more than one year.lets wait for other experts comments

There are 2 parts to your problems.

Money issues: Unless you have got her co-signed you can't do much and take it your stride it was bad decision and move on, either by selling back car, whatever other asset you have.

Second get hold of some lawyer who is not in good terms with your Jijai provoided you all stay in same city. Use a comptent lawyer to fight the case based on merits.

You should get maintainance cleared off by now. Stating her living status , her education.. If you lose this case then you're hooked for life and you will be milked .

Secondly, DV is just threat for MCD. Again use a lawyer to fight this. State the facts and get this quashed at first instance. It mayn't be possible. Or atleast this will drag on forever. It's her case to prove . Don't worry case will not stand. But it is headache neverthe less.

Now finally, get the part of her adulterous life off your head. You doubt and you don't have solid proof. And spending time and energy is not worth your while . Jijai will get tired if she can't get him free meals.

Good lawyer is your best bet. Rest is life sometime teaches harsh lesson

Before disposing off beauty parlor, keep a record of everything to substantiate that she is capable to earn herself. If you escape from paying maintenance, half or almost all full battle is won. So convert your suicidal instinct to killer stinct and win maintenance battle vigorously. Your parents attendance is not compulsory on every date. And even your mother can file a DV against your wife as counter blast.

I have seen many lawyers cheating with their own professionand, they're just making money out of your problem and pain.
