Due outstanding amount

Dear All,

In my company,client does not paying outstandig amount after giving so much time,doing email,letter and telephonic conversation. Now what we do ?? to file case under civil or criminal or both??pls help

Hi,

Collect the documents related to the transction, Invoices, emalis, service agreement if any (evidence).. and send him a legal notice through an advocate for demand of the due amount. Mention the time of 15 days to pay the money with interest.. and if he doesn't pay or denies to pay.. then file a recovery suit.

in our case directors are not traceable, as they not reside at address as mentioned in roc records. so at which address we will send legal notices??

Mam, 

 

Civil for recovery and Cheating in criminal both be filed parlelly, even the directors are not traceable, you can send the notices on the Company making them a party, because directors are just the mind of the company (but talking legally and going through the relevant provisions of the Companies Act) directors may come and go, but company would always remain laible.

Hi,

Try to find out their addresses.. if you don't get the addresses you can send the notice on the old address available with you and even publish a public notice in the local newspaper for the same. And failing to respond.. file a suit..
