Electronic evidence submission in domestic violence case

Hi Form,

can a cd of sms,mobile recordings / call recordings and emails be submitted as evidence in the court?

is the printout of emails/SMS  taken as evidence? and whats the procedure of getting these submited as evidence in a domestic violence case.

Yes electronic evidence accepted  as per conditions mention in  Evidence Act .

so can i take printouts of these mails and submit it alongwith the affidavit?

before submitting the mails( must be supported by affidavit) discuss with your lawyer .

Electronic record is acceptable under section 65 B of evidence act.   As u have already taken mails and call conversation record, submit it to the court and obtain the call data from the court., which very much important to prove ur case, as the call data shall be authenticated by the service provider.  The service provider keep the data for certain period only. act fast.

   If u r a complainant, u apply through prosecution or if u r accused u apply through ur advocate
