Eligibility req for d post of Chairman of a co-op hsg soc.

Can a person become the Chairman of a co-op hsg soc if d flat isn't registered in his name(it is registered on his wife's name) ? If no, then what action is to be taken against him ?

In our soc, our builder is only our Chairman but his flat is registered on his wife's name(as per Sale deed) ? Can he be appointed as d Chairman of the soc ? All soc decisions are taken and signed by him only .
