Employee termination

Dear Sir, 

 

I was working  with a Pvt sector Bank for three and half years. I was following up with my Regional HR Manager for transfer to or nearer to my home location since April 2014,  followup for the transfer was continues and during this period I have  never defaulted to perform my underlying tasks or duties or been at unauthorised absenteeism, suddenly in the month of March 2015 I was asked by my Regional HR and superior authority to put my resignation immediately   else I will be terminated. I asked for a justification for the same and also argued that no HR memo or stinkers or any performance  related issue has been raised against me during the period so why do I put my resignation, indeed a termination letter was issued to me on March 5,2015 without any reason but soughting the extant of employees agreement. As per this letter I was supposed to get my 90 days salary in the lieu of noticed periods, but I have received the salary for two months only that too in installments first on 25th March and second on 9th May which ideally should have been paid to me at once and immediately after my termination. 

I would also like to share that -

I wasnever issued any performance or disciplinary related HR memos. 

My gross salary was rs 51000.00 per month. 

I wasworking in the position of backup Branch Manager. 

Since Iwas on a supervisory position but I had no power to sanction any leave or any kind of promotion. 

Kindly suggest how can Ichallenge my termination and file a complaint against the organisation.

I agree with the Vasudevan here you need to send this total information to the Labour commission that termination of services with out providing any valid act or condition such type of immidiate temination if any bank or industree want to do they need to take approval from the concern Labour commissioner was this under excess man power if no then was there in any kind or behavioural issue or wrong full act done in that case any industry must to issue show cause or warning letter if its not received to you then you can go through the labour court, labour commissioner directly for justice
