enquiry regarding ancestors property

sir

I want to know that how can the ancestors property can be divided in legal way , my grandfather have 3 son but the biggest one is not agree for equal share in property ,

i want to know that how can we get our share in the ancestors property with legal path.

my grandfather haven't made any will .

Which personal law applies in the case?

Or are all involved; Hindu?

Who was 1st title holder; your grandfather or his ancestors?

Was self earned/acquired funds invested to buy the said property?

IT is self earned/acquired in the hands of your grandfather?

Assuming that IT is self earned/acquired in the hands of your grandfather; he does not need anyone’s agreement/approval/consent etc can dispose his estate/property in anyone’s favor by a valid/registered deed e.g; WILL, Gift etc etc …He can mention boundaries…

Approach your own very able senior LOCAL counsel of unshakable repute and integrity specializing in testamentary/succession/civil matters and having successful track record ….. and worth his/her salt …and discuss in person and even with seasoned PIP and proceed in best of your interest.. 

Check at LOCAL Civil Courts, HC,SC……..

Ancestral Property; as in Hindu's is one that is ;

four generation old.

 

Any property acquired by the Hindu great grand father, which then passes undivided down the next three generations up to the present generation of great grand son/daughter.

Sir It is fourth generation. Old and my grandfather have the property in 2 different states , but the 1st son of the grandfather is not agreeing in equal divide ratio and he didn't accept the panchayat solution. Pls help me in this step by step as I didn't have much knowledge about courts and this type of matter . My family is hindu

The Co-sharers along with grandfather in thier life time may devide with boundaries...and register IT.

Approach your own very able senior LOCAL counsel of unshakable repute and integrity specializing in revenue/civil matters and having successful track record ….. well versed with local revenue codes/laws ...and worth his/her salt …and discuss in person and even with seasoned employee’s/trade union leaders and proceed in best of your interest..
