Evading court process by false statements by family members

 

In a Cheque return case under the NIA, the magistrate issues the bailable warrants but the same were being evaded by the accused, by making false statements through the Family members of the accused in collusion with the accused that the accused is not in the city (even though when he was very much in the city).

The intention was to mislead the court and evade the court process

My query is

1.What action can be taken against the accused & the Family members &

2.Whether a miscellaneous application can be filed in the same court bringing this to the notice of the court and praying for action

Was the statement given under oath ?

( or statement made being recoreded by magistrate)

No statement was given on oath

When the Police went to serve the Bailable warrant it was evded by making that statemnet to teh Police

The Police filed that statement in the Court
