Evidence validity

I have  some recordings about the cruelty of my wife. But those are older than 3 months. I have heard somewhere that recordings older than 90 days are not valid in Indian court. Is it the case? please suggest

  • The recording device must have been capable of taking the conversation now offered in evidence
  • The operator of the device must be competent to operate the device
  • The recording must be authentic and correct
  • Changes, additions or deletions have not been made in the recording
  • The recording must have been preserved in a manner that is shown to the court
  • The speakers must be identified
  • The conversation elicited was made voluntarily and in good faith, without any kind of inducement.

thanks a lot sir. I have moved the recordings from my phone to my computer but have not altered anything. Please suggest will the movement of those recordings to my computer will make these evidences as useless?

Dear Neeraj evidence should be primary.As u moved your recording to computer from phone.It may be invalid as recording in computer is seondary.So,court may invalid your recording.You should produce your phone to court.
