Ex parte and evidences

The stage of Petitioner’s  submitting the evidences is only after the reply is received from the Respondent. If no reply received the case is ex parte.?

The court will not straightaway order exparte evidence within one hearing wherein the respondent has not filed his reply.  The respondent will be given sufficient chances and then also if there was no representation from respondent side, the court may set the respondent exparte and exparte evidence may be ordered.

The respondant will get sufficient chances to file her reply if she failed in do so only then court set The case ex -parte and order for ex-parte evidence .

Court never pass ex-parte evidence this is voilation of natural justice without hearing both parties court never pass orders. But if a party is not cooperating or not comming to court court passes orders after nill opportunity given. Due process has to follow thereafter court pass ex-parte orders.
