Execution petion

Hi experts,

 

I made an agreement with a party to buy a land in chennai in early 2000 and paid advance amount. The party after taking advance amount and also some more amount refused to register the land in my favour. I appointed an Advocate to deal with this case. The court case went on for more than 1 2years and finally I won the court case " on exparty :

The owner of the land passed away and did not attend court and so the court has decided in my favour on exparty.

Now the land is registered in my name. The court has registered the land for me and judge has signed in sale deed also. I have appointed a power of attorney to deal with court case, so the land is registered in my name and the power of attorney's name also mentioned in sale deed as power holder. 

 

I understand that I have to apply for execution petition to take posession of the land. 

I want some expert advice on following :

1) To revoke power of attorney. I f I revoke power of attorney, what shall I do?

2) Apply to court for EP ? what needs to be done ?

3) How long it takes to take posession?

4) MOST IMPORTANTLY I NEED TO HIRE AN ADVOCATE WHO IS SPECIALISED IN EXECTION PETITION ISSUES IN CHENNAI. some one who can suggest?

You can revoke the power of attorney by making a deed of revocation and registering the same at the local registrar's office where the property is located. Also, as a matter of abundant precaution, you may write letters to the authorities connected to the property that you have revoked the PoA and that no one should deal with the earlier PoA holder and deal directly with you.

To apply to the court for EP, you should appoint a lawyer who will take care of the procedures also.

It takes a few weeks to get the possession but depends on the Court and your luck.

Regarding chennai based advocate, it is better to enquire locaally.

Thanks Jadav . Can you suggest or any one here suggest a good Lawer who can handle the issue?

The Lawyer must be experienced in EP matter to handle in chennai.
