Dear Sir,

Two years before my marriage was happen & my wife stayed with me 2 days only (Day one onwards said she said not interested to serve with me) and went her home and filed dowry case. After a long discussion in Police station, finally she wants to go mutual divorce. So we are accepted and after a year asked her home to apply divorce, but her member said not ready to give divorce and same time she was not serve with you…So I don’t to proceed further, In mean time met lot of personal
& professional problem have faced. So recently my second year was completed again asked her home, there is no reply due to that I have applied a divorce case. Now after receiving the petition her family people says to go mutual divorce and say to with draw my case. I am not able to believe there words, so please let me know shall I keep my case as it is and proceed this mutual divorce or need to with draw my case.

So kindly suggest me for further steps.

let them appear in the court and let your wife make an oral or written submission that even she wants divorce by way of mutual divorce without any condition. Ask your lawyer who is handling your divorce case.

Contested divorce will take a lot of time.  So, agree with their condition and ask them to come to court where your divorce petition is pending and give a statement that she is interested in MCDand withdraw your case.  Immediately file MCD and six months after you will get divorce.

Dear All

Thanks for your reply...

Based on my previous exprience with her family,Once i have withdraw the case may be they will not come back for after six month of final judgement.So Please let me know if it possible to keep my case open upto the final judgement of MCD & Kindly let me know law will allow to keep one case and proceed through MCD..

Both MCD and contested divorce case cannot go together.  You have to withdraw the latter one to file the former one.
