ALONGWITH ABOVE SUGGESTIONS:

1. Complaint to "legal metrology organization ( LMO)" who are bound to under Legal Metrology Act, 2009 and Legal Metrology (Packaged Commodities) Rules, to Penalize Vendors for over charging on ANY item that is sold beyond MRP and/or selling Expired or damaged products.

Hey, 

I agree with all the above experts. Please first obtain reciept of the same and approach the Legal Metrology Organization along with the Consumer forum. Before, you approach the consumer forum send a legal notice to them to compensate you failing which you will approach the consumer forum.

Do you have receipt for payment and package of the product ? If so, move to consumer commission of jurisdiction.

It is the duty of  LMO to conduct a raid and confiscate such expired items, once a complaint is received from a reliable source.  Let them perform their duties and your duty is to make a written complaint and see that there are no compromises by LMO with such shop.

I am of the view that selling expired products are a criminal offence, as the expiry date was prescribed by the authorities since usage beyond that date shall endanger the person/s who use or consume it.  Therefore, the person selling the expired products is committing an offence knowingly, and hence a complaint with Police can be tried with full proof. Of course, the attendant issues of going to Police Station several times, going to Court along with the offender shall follow for which one should be ready.
