Company A had filed an application for removal of Auditor under 224(7) and the Regional Director ROC after several written sumission passed order for removal. Though the order approved the removal the same was in favor of the Auditor as many allegations raised against the said auditor was totally sidelined in the order. Company has filed a review of order and the same is pending with RD for two years.
While the proceedings for removal has happened, senior partner of the firm has made several false statements in the submission before the Regional Director. Therefore company filed a complaint with RD to take criminal case for making false statements. Reginal Director is saying that criminal case cannot be filed. can some one help with legal side on this.
