Family not giving me my share of property

dear Sir/madam,

Could someone clarify if one partition suit filed in mumbai could take care of both the property ( land in punjab & mumbai flat).

Madam Adv. Archana said two suit need not be filed one suit would be enough, on the other hand Adv. Mr Ashish Davessar has mentioned that I need to file two suits one each in the local court that has jurisdiction over the property.

Can anyone please clarify the same.

Plz go through s. 17 of cpc

 

17. Suits for immovable property situate within jurisdiction of different Courts— Where a suit is to obtain relief respecting, or compensation for wrong to, immovable property situate within the jurisdiction of different Court, the suit my be instituted in any Court within the local limits of whose jurisdiction any portion of the property is situate 

So what is the need to file two seperate suits?

Part of your properties is situated within the jurisdiction of the court in punjab and part of it is situated within the  jurisdiction of mumbai court. So, you can file a suit at any one place of your choice. The entire claim is cognizable by such Court.
